Please read these terms carefully before booking a session or using this website. By engaging Heirmark's services, you confirm that you have read, understood, and agreed to these terms.
1. Definitions
- "Heirmark", "we", "us", "our" โ refers to Heirmark, operating from 18 Jalan Bukit Bintang, 55100 Kuala Lumpur, Wilayah Persekutuan, Malaysia.
- "Services" โ the estate document organisation sessions and family heritage workshops offered by Heirmark, as described on this website.
- "Client", "you", "your" โ the individual or household making an enquiry or booking a session.
- "Website" โ the Heirmark website at heirmarked.biz and all associated pages.
- "Session" โ a booked appointment or programme, whether the Family Records Inventory Session, Heritage Reference Workshop, or Heritage Records Programme.
- "Agreement" โ these Terms & Conditions together with any booking confirmation issued to you.
2. Acceptance of Terms
By submitting an enquiry, confirming a booking, or using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are booking on behalf of a family household, you confirm that you are authorised to do so on that household's behalf.
If you do not agree to these terms, please do not submit an enquiry or proceed with a booking.
3. Service Description
Heirmark provides estate document organisation and family heritage workshop services. All sessions are informational, organisational, and educational in scope. Specifically:
- The Family Records Inventory Session assists households in building a labelled inventory of personal records, certificates, and photographs. It is organisational only and does not include any opinions on legal matters, beneficiary rights, or asset division.
- The Heritage Reference Workshop is a small-group session helping families assemble a shared printed reference binder for family records and keepsakes. The session does not include opinions on specific household matters.
- The Heritage Records Programme is a multi-session programme guiding families through the thoughtful organisation of long-term heritage records, covering inventory, label design, scanning checklists, and a final printed handbook. It is educational and archival in scope.
Services are available to households located within or able to travel to Kuala Lumpur, Malaysia. Heirmark reserves the right to decline bookings at its discretion.
4. Scope Limitation and Educational Nature
Heirmark's services are strictly organisational and educational. Nothing communicated during a session, in any written material, or on this website constitutes legal advice, financial advice, estate planning advice, or any form of professional representation. Heirmark facilitators do not hold themselves out as legal practitioners, solicitors, estate planners, or financial advisors.
Clients requiring advice on matters such as wills, beneficiary entitlements, asset distribution, property rights, or related legal or financial questions should seek independent professional guidance from a qualified practitioner.
5. Booking and Confirmation
- A booking is confirmed when Heirmark issues a written confirmation via email.
- Enquiries submitted via the website form do not constitute a confirmed booking.
- Heirmark will respond to enquiries within two business days where possible.
- Session dates are subject to facilitator availability and are not confirmed until written confirmation is issued.
6. Payment Terms
- Session fees are as published on this website at the time of enquiry. All fees are quoted in Malaysian Ringgit (RM).
- Payment arrangements, including deposit and balance schedules for the Heritage Records Programme, will be communicated at the time of booking confirmation.
- Payment methods accepted will be stated in the booking confirmation.
- Fees are inclusive of the session itself, any printed materials described in the service description, and the facilitator's time.
7. Cancellation and Rescheduling
- Client cancellation with more than 7 days' notice prior to a session: full refund or rescheduling at no charge.
- Client cancellation with 3โ7 days' notice: 50% of the session fee will be retained as an administrative charge, with the remainder refunded.
- Client cancellation with fewer than 3 days' notice: the full session fee is non-refundable, unless exceptional circumstances apply at Heirmark's sole discretion.
- Heirmark cancellation: If Heirmark cancels a session, clients will be offered a full refund or a rescheduled session at no additional cost.
- Rescheduling requests are subject to availability and must be made at least 48 hours before the original session time.
8. Client Responsibilities
- Clients are responsible for bringing any materials, documents, or photographs they wish to include in the session's inventory or archive work.
- Heirmark does not retain originals of any documents or photographs. All original materials remain with the client at all times.
- Clients should ensure that materials brought to sessions belong to them or that they have the right to handle and index those materials.
- For the Heritage Reference Workshop, clients attending as part of a group are each responsible for the materials they bring.
9. Intellectual Property
All content on this website โ including text, design, illustrations, and organisational frameworks โ is the property of Heirmark and is protected under applicable Malaysian intellectual property laws. You may not reproduce, copy, distribute, or use any website content for commercial purposes without prior written permission.
The printed materials issued to clients during sessions (inventory sheets, binders, handbook templates) are provided for the client's personal household use only and may not be resold or commercially reproduced.
10. Confidentiality
Heirmark treats information shared during sessions with care. Facilitators do not discuss the content of one client's session with any other party. For full details of how personal data is handled, please see our Privacy Policy.
11. Disclaimers
- Heirmark's services are provided as an organisational and educational resource. We make no representations as to the completeness or accuracy of any inventory produced, as the completeness of the inventory depends on the materials the client provides.
- Heirmark does not verify the authenticity, validity, or legal standing of any document handled during a session.
- Website content is provided for general informational purposes only and may not reflect recent changes in law or practice.
12. Limitation of Liability
To the fullest extent permitted by Malaysian law, Heirmark shall not be liable for any indirect, consequential, or incidental loss arising from your use of the website or the services, including but not limited to loss of data, loss of documents, or reliance on session content for legal or financial decisions.
Heirmark's total liability in connection with any session shall not exceed the fee paid for that session.
13. Indemnification
You agree to indemnify and hold harmless Heirmark and its facilitators from any claims, liabilities, costs, or expenses arising from your breach of these terms, your misrepresentation of the materials you bring to sessions, or your reliance on session content for purposes beyond organisation and education.
14. Termination
Heirmark reserves the right to decline or discontinue services to any client whose conduct during a session is disruptive or inappropriate, without refund. Either party may terminate an ongoing programme arrangement with 14 days' written notice, subject to pro-rated fee adjustment for sessions already completed.
15. Dispute Resolution
These terms are governed by the laws of Malaysia. In the event of a dispute, both parties agree to first attempt resolution through good-faith correspondence. If not resolved within 30 days, the matter will be referred to mediation before any formal legal proceedings are initiated. The courts of Kuala Lumpur, Wilayah Persekutuan, shall have jurisdiction.
16. General Provisions
- Entire agreement: These terms, together with your booking confirmation, constitute the entire agreement between the parties in respect of the services.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- No waiver: Failure to enforce any term does not constitute a waiver of that term.
- Assignment: You may not assign your booking to another party without Heirmark's written consent.
17. Changes to These Terms
We may update these terms from time to time. Updated terms will be published on this page with a revised effective date. Continued use of the website or booking of services after an update constitutes acceptance of the revised terms.
